1. Acceptance
By engaging any Shift Digital service or using this website, you fully accept these Terms of Service. If you disagree, please refrain from using the site or engaging our services.
2. Service description
Shift Digital offers productized digital services: Landing Page, Corporate Website, Automation Pack and WhatsApp AI Agent. Each service has a fixed scope described in the commercial proposal sent to the client.
3. Process and timelines
Standard delivery is 7 business days from payment confirmation and receipt of a complete brief. Timelines may extend if the client does not supply materials (copy, images, credentials) within agreed timeframes.
4. Pricing and payments
Prices are detailed in the commercial proposal. Payment is 50% upfront and 50% on delivery. All prices are in USD unless otherwise stated. Applicable taxes are the client's responsibility according to their jurisdiction.
5. Intellectual property
Upon full payment, the client receives usage rights to the delivered website. Source code and proprietary design systems (Kinetic Void) remain the intellectual property of Shift Digital. Automations built on third-party platforms are subject to those platforms' terms.
6. Warranty and support
We provide 15 days of post-delivery support to fix functional bugs arising from our work. This does not cover scope changes, content updates or errors caused by client modifications.
7. Limitation of liability
Shift Digital is not liable for loss of business, revenue or data arising from use or inability to use the delivered site. Our maximum liability is limited to the amount paid for the contracted service.
8. Cancellation
The client may cancel before work begins and receive a full refund of the deposit. Once work has started, the deposit is non-refundable. If Shift Digital cancels without justified cause, 100% of payments received will be refunded.
9. Governing law
These terms are governed by the laws of the Republic of Colombia. Any dispute shall be submitted to the competent courts of Cali, Colombia.
10. Modifications
Shift Digital reserves the right to update these terms. Changes will be communicated at least 15 days in advance through the website.
